AB-49 (Safe Haven Schools Act): What It Means for Students and Families

On September 20, 2025, Governor Newsom signed Assembly Bill 49 (AB-49) into law. This legislation took effect immediately and provides new protections for students and families.

Key Provisions of AB-49

  1. Restricted Access to Schools
    School staff may not allow immigration enforcement officers into non-public areas of a school site unless the officer presents a valid judicial warrant, subpoena, or court order.

  2. Verification of Identification
    Staff are required to request valid identification from any immigration enforcement officer seeking entry to a school site.

  3. Protection of Student & Family Records
    Schools may not disclose student education records or family information to immigration enforcement without:

    • Written parent/guardian permission, OR

    • A valid judicial warrant or subpoena.
