CSEA – Juneteenth Settlement Information

NOTICE OF POTENTIAL ELIGIBILITY FOR COMPENSATION

On November 21, 2024, the Alameda County Superior Court approved a class settlement in California School Employees Association v. Albany Unified School District et al., Case No. 22CV005456 concerning Juneteenth holiday pay for eligible classified employees (“Settlement”). Pursuant to the terms of the Settlement, the ABC Unified School District is providing this notice to all classified employees that they may be eligible for compensation pursuant to the Settlement. Compensation to Eligible Employees shall be in the form of a credit for paid vacation time off in an amount equal to the number of hours actually worked on June 18, 2021, and/or June 20, 2022, and/or June 19, 2023.

“Eligible Employees” shall include (a) current CSEA bargaining unit members as of November 21, 2024, and (b) classified employees who retired as of March 1, 2024, and who continued to be members of CSEA as of November 21, 2024. All such employees must meet one or both of the following conditions:

  • Employee was required to and actually worked on Friday, June 18, 2021, and was in paid status during any portion of the day before or the day after June 18, 2021.
  • Employee was required to and actually worked on Monday, June 20, 2022, and was in paid status during any portion of the day before or the day after June 20, 2022.
  • Employee was required to and actually worked on Monday, June 19, 2023, and was in paid status during any portion of the day before or the day after June 19, 2023

STEP ONE: Process for Submitting Claims

To make a claim for compensation under the Settlement, you must complete and return the attached Claim Form within 60 days from the date of this notice. The deadline to submit your Claim is March 10, 2025.

The District will provide a Determination on your Claim no later than May 10, 2025, along with:

  1. a Compensation Notice and Employee Waiver; and
  2. a Dispute Form and Resolution Agreement. Further information concerning the Employee Waiver and the dispute resolution process will be provided along with the Determination on your Claim.

STEP TWO: Determination of Your Eligibility and Amount

After OSD receives your claim form, it will review internal records to determine your eligibility for compensation and how much you are owed.  You will be notified of these results. Employees will receive their eligibility determinations and compensation amounts by letter, sent via US mail to your last known address on file with Human Resources, on or about April 21, 2025. 

STEP THREE: Sign the Waiver or File a Dispute

After you receive your eligibility determination and compensation amount via letter, you must sign and return the employee waiver in order to receive the determined compensation.

You must submit your waiver timely, and it must be received on or before May 23, 2025 by the Human Resources Department.  Late waivers will not be accepted.

If you receive your eligibility determination letter and disagree with the OSD’s assessment of your eligibility or the determined amount of compensation, you may file a dispute.  Your dispute form and resolution agreement must be submitted to Human Resources on or before May 23, 2025. Disputes will be handled according to the dispute process outlined at Paragraph 7 of the Settlement Agreement.  Late dispute forms will not be accepted.

STEP FOUR: Receive your Payment

If you were eligible for compensation and timely submitted your claim form and employee waiver, OSD will make payments as soon as possible.  Compensation is equal to the actual amount an employee earned on Juneteenth in 2021, 2022, and/or 2023 less standard and customary payroll deductions.
